The Landlord and Tenant Board (LTB) is Ontario's specialized tribunal for resolving disputes between landlords and tenants. Most hearings are now conducted online via videoconference, though some in-person options remain available.

Before the Hearing

Both parties receive a Notice of Hearing with the date, time, and method (online/in-person). Prepare by:

  • Gathering all relevant documents (lease, receipts, photographs, correspondence)
  • Identifying any witnesses you want to call
  • Reviewing the law and LTB rules applicable to your application
  • Arriving or logging in 15-30 minutes early

At the Hearing

LTB hearings follow a relatively informal process compared to court:

  1. The adjudicator opens the hearing and confirms the parties
  2. The applicant presents their evidence and arguments first
  3. The respondent can question (cross-examine) the applicant's witnesses
  4. The respondent then presents their evidence and witnesses
  5. Both parties may make closing submissions
  6. The adjudicator may issue a decision immediately or later in writing

Evidence Rules

The LTB's rules of evidence are more flexible than court. You can submit photographs, text messages, receipts, and written statements. Make sure to bring multiple copies of all documents.

Possible Outcomes

  • For landlords: eviction order, rent payment order, damages
  • For tenants: rent abatement, maintenance order, dismissal of eviction, return of deposits

After the Decision

LTB orders can be enforced through the court system. Eviction orders are enforced by the Court Enforcement Office (Sheriff). Either party can request a review of a decision if there was a serious error.
