Do Grandparents Have Automatic Rights in Ontario?

In Ontario, grandparents do not have automatic legal rights to see their grandchildren. However, they do have the legal right to apply for contact or parenting time with their grandchildren under both Ontario's Children's Law Reform Act (CLRA) and Canada's federal Divorce Act (where the parents are or were married). Whether that application succeeds depends on whether contact is in the best interests of the child.

Who Can Apply?

Any person — not just grandparents — can apply for "contact" with a child under section 21 of the CLRA. Grandparents and other third parties must demonstrate the importance of the existing relationship with the child and that contact is in the child's best interests.

The Best Interests Test for Third Parties

For grandparent access applications, courts consider:

  • The nature and quality of the existing relationship between the grandparent and the grandchild
  • Whether the child would benefit from continued contact
  • The parents' reasons for withholding contact
  • The wishes of the child (depending on age and maturity)
  • Whether contact would disrupt the child's settled environment

The Parental Autonomy Principle

Canadian courts give significant weight to parental autonomy — the right of fit parents to make decisions about their children's lives, including who they have relationships with. Courts generally do not interfere with a parent's decision to limit contact with grandparents unless there is clear evidence that this limitation is not in the child's best interests.

Practical Steps Before Applying

Before filing a court application, consider: engaging in open communication with the parents, proposing mediation to discuss contact arrangements, and documenting your existing relationship with the grandchild (photos, communications).
